Missouri outlaws cyberbullying after tragic MySpace suicide of teenager Megan Meier

Associated Press reports:
(O'Fallon, Missouri) Missouri Gov. Matt Blunt signed a bill Monday outlawing cyberbullying, just miles from where a 13-year-old girl committed suicide nearly two years ago after being harassed on the Internet. Megan Meier killed herself in October 2006, shortly after receiving mean-spirited messages over the Internet. Her suicide prompted the bill.

The teenager's mother, wearing a picture of her daughter in a pin on her dress, stood over the governor's shoulder as he signed the bill at a St. Charles County library. Tina Meier said she was grateful but said much more needs to be done to make sure children are kept safe. "This is certainly not the end," she said. "Bullying and cyberbullying is something that takes place every day. This is not just one case with Megan." READ MORE

Eenie, meenie, minie, moe?

United Press International reports:
A New York drug counselor says he is trying to get his job back after being fired for reciting a children's rhyme an African-American colleague found offensive. Donald Cross, 65, said he is dumbfounded by the town of Babylon's move to dismiss him for alleged racial harassment, the New York Daily News reported Sunday.

Donald Cross said he has lodged a complaint with the state Division of Human Rights in an attempt to return to the job he worked at for 15 years. He also initiated a $10 million federal lawsuit, claiming his civil rights were infringed. Cross said he was saying the rhyme in his mind when he had an interaction with Kathleen Wood, 71, last January. How did you learn 'Eenie, meenie, minie, moe?' Cross asked her. Wood was reminded of the version of the rhyme that says, catch a n----r by the toe, court documents indicate. I know the rhyme and I just didn't want to hear it, Wood said in court.

Talk show host wins important libel case

Rafe Mair wins libel suit in Surrey gay-book case
Tobin Dalrymple, Canwest News reports:

In October 1999, Rafe Mair (pictured), a well-known host on CKNW radio [Vancouver, Canada], read an editorial regarding Kari Simpson, a high-profile social activist. Simpson opposed any positive portrayal of a gay lifestyle in public schools, according to the justices' ruling. Mair, in his editorial, compared her to historically racist and violent people.

"Now I'm not suggesting that Kari was proposing or supporting any kind of holocaust or violence but neither really . . . neither did Hitler or Governor Wallace or [Orval Faubus] . . . they were simply declaring their hostility to a minority . . . Let the mob do as they wish," he said, according to a transcript in the ruling.

The [9-0 judgment Friday, June 27] ruling sets a precedent by employing an "objective test" to grant fair comment. READ MORE

Canadian Supreme Court throws out libel case
Canadian Press reports:

The country's top court has absolved former Vancouver radio personality Rafe Mair of defamation for a commentary in which he made reference to the Ku Klux Klan and Adolf Hitler. The Supreme Court of Canada decision in the defamation suit also broadened a key defense often used by journalists to ward off libel actions.

In a 9-0 judgment Friday, the Supreme Court of Canada ruled that Mair was engaging in fair comment in the 1999 radio editorial that was critical of Kari Simpson, a high-profile player in a campaign opposing the use of teaching materials about gay life in local schools. "I was relieved that it was over. I felt that I should have been vindicated and I am, so there we are,'' Mair said after the ruling.

In the course of the [Mair's] editorial, the controversial former radio commentator made references to the Klan, Hitler and skinheads, although he claimed he wasn't saying that Simpson actually advocated violence against gays. Simpson sued and the trial judge found that, despite Mair's disclaimers, his words could be understood by listeners as implying that Simpson condoned violence. READ MORE

Canadians urged to support gay rights abroad

Canada, as a relatively safe haven for gays and lesbians, has a responsibility to fight for homosexual rights abroad and open its doors to those escaping persecution because of their sexual orientation, a Pride Week panel discussion heard. "There are 86 countries in the world where we would be arrested just for being in this room," Rev. Brent Hawkes (pictured) of Toronto's Metropolitan Community Church told the panel Monday night. "In 10, we would be executed," Hawkes continued.

Scott Long of Human Rights Watch said despite what many believe, persecution of homosexuals often has more to do with culture than religion. For instance, in Turkey, he said, the Islamist party now in power has shown more sympathy for gay rights than the secular party that ruled before it. READ MORE

Lesbian insults spur human rights complaint against comic

CBC reports:
(Vancouver, Canada) Lorna Pardy filed a complaint alleging she and her lesbian partner were the targets the offensive comments made by Guy Earle (pictured), who was hosting the open mic night at Zesty's Restaurant on Commercial Drive in May 2007. Earle doesn't deny he was offensive, but claims Pardy and her same-sex partner first rudely heckled him, along with the amateur comics onstage that night. He told CBC News Wednesday that he lost his cool and shot back with some deliberately offensive lines of his own to shut them up.

Following what he calls his on-stage "tirade," Earle says he walked past the table where the women were seated and was doused with a glass of water. After the show, he says he went back to the women's table to make peace with them, but more water was thrown at him. Frigon's account confirms that the women threw water in Earle's face. It also alleges that the comedian later returned to their table, took one of the women's glasses and broke them. Earle does not deny it. "I took the sunglasses off her head and broke them in half," he admits. He says he regrets breaking the glasses, and offered "publicly" to replace them. But he argues that he was "assaulted" twice before reacting.

However, in a November 2007 interview with the Internet-based Dave and Chuck Show, Earle spoke more openly about what he said at the show. "This is like an audio affidavit here," he stammered when asked what he said. However, Earle continued: "I said, 'come on - you're fat and ugly, you're not even lesbian, no guy will f--k you, that's why you're with each other.'" Then he suggested they perform fellatio to keep from talking. "Which one of you wears the strap-on dildo?" he asked.

Earle said one of Pardy's complaints was he told her and her friends to go home and use a sex toy on each other. But Earle argued he instead told them to use a strap-on sex toy on him. "There's a big difference. You just change one little verb and you take it out of context and all of a sudden it's time for me to drink a glass of hemlock," he said. "They were drunk, they were being jerks and I was very rude and visceral to them because, like I said, if you have a heckler what you want to do is put them in their place by offending them, so I tried to hit them where it hurts and the only thing I had to key on was the fact that they were lesbians. "I don't care if they're lesbians, heterosexuals, homosexuals or giraffes."

Earle said the complaint is an attack on comedians' right to perform. "I would never have expected it would get escalated to a philosophical battle." He added it's been more than 40 years since controversial U.S. comic Lenny Bruce was jailed for obscenity over his comic material - "and we're still fighting the same battle. I know it's a fight I can never win. But I've got to keep fighting."

Earle is holding a benefit concert on July 19 in Toronto to raise money for his legal fees.

70 % of Jamaica Oppose Any Rights For Gays!!!

(Kingston) There is little chance laws against homosexuality will be repealed in Jamaica if a public opinion poll released Friday is any indication. The survey found that 70 percent of Jamaicans do not believe gays and lesbians should have any civil rights. Jamaican gays, supported by international human rights groups, have been calling for repeal of the sodomy law which carries a sentence of 10-years in prison on conviction. READ MORE

Teenage girl allegedly beaten by Grandmother after being caught having lesbian sex!

(Reading, Pennsylvania) A 61-year old woman is in jail awaiting trial for allegedly beating her granddaughter with a cane and a belt after finding the teen in bed with another girl. Joyce Y. Beddell (pictured) is charged with aggravated and simple assault, recklessly endangering another person and endangering the welfare of a child. She is being held in jail in lieu of $10,000 bail.

Police said that Beddell discovered her granddaughter in bed having sex with a neighborhood teen girl. The neighboring teen ran when Beddell entered the room, according to police, and escaped the elder woman's wrath. The granddaughter was not so lucky.

Beddell allegedly took a cane and then a belt to the 16 year old. She then forcibly took the girl from the house. READ MORE

Gay soldier's fate grips Brazil

BBC reports:
Sgt Laci Marinho de Araujo and his partner, who is also a sergeant in the Brazilian army, featured on the front page of Epoca magazine. They gave an interview in which they talked openly about living together as a gay couple. However, while they were taking part in a television interview on Wednesday, Sgt de Araujo was arrested by military police who surrounded the TV station until he came out. READ MORE

Gay arrests in Uganda condemned

BBC reports:
Human rights group Amnesty International has strongly condemned the arrest of three homosexual rights activists at a Ugandan Aids conference. Amnesty said it was concerned for the safety of those arrested because of a "history of harassment and degrading treatment" of gays by the police. A police spokesman said they could face charges of criminal trespass. But Amnesty UK director Kate Allen called for their immediate release. "We consider these three to be prisoners of conscience, detained for their peaceful activism," she said. MORE

Anti-gay hate crimes up in 2007

National Coalition of Anti-Violence Programs, 30 member programs report that gay-bashing incidents rose 24% compared to 2006. Statistics in the NCAVP report show that the largest inrease in anti-LGBT incidents happened in the nation’s heartland. Anti-LGBT violence was up:

  • 135% in Minnesota

  • 207 % in Michigan

  • 142% in Kansas City

      Male rape victim, "Brian", shares his story

      The U.S. Justice Department says one in every 10 rape victims is male. According to a national study, about three percent of American men (2.78 million) have been the victim of an attempted or completed rape. Around 60 percent of these men identify as gay or bisexual.

      Despite the sobering figures, the Rape, Abuse and Incest National Network says male victims are less likely to file a crime report. Much of this has to do with the myths attached to male-on-male rape. These fictions are commonly used to re-assign blame (getting an erection proves a man wants it), downplay the crime’s severity (it’s not as bad for a man as it is for a woman) and outright deny the existence of male same-sex rape. For instance, North Carolina law does not recognize that a man can rape another man. Therefore, when both parties are male, cases that would be considered rapes elsewhere are prosecuted as sexual assaults in North Carolina. When they are prosecuted, that is.

      The story of a 25-year-old, identified here by the pseudonym "Brian", will be told in two-parts. Part one, presented here, is a narrative detailing the events of the crime as alleged by the victim. Part two, appearing in the next issue of Q-Notes, will be an investigative piece on the treatment Brian received when he approached the agencies charged with assisting victims.

      Politician who apologized for anti-gay remarks a no-show for Regina Pride parade

      Canadian Press reports:
      (Regina, Canada) Tom Lukiwski, a Conservative MP, who promised earlier this year to spend his life promoting tolerance after a video surfaced of him making anti-gay [and racist] remarks in 1991, was a no-show Saturday at Regina's Gay Pride parade. [QTC: what a coward!]

      Gay groups said they were disappointed that Regina-Lumsden MP Tom Lukiwski (pictured) didn't even respond to an invitation to attend the parade. "Mr. Lukiwski stated in his public apology ... that he would spend the rest of his life making amends," said Gay Pride spokesman Nathan Markwart. "Well, when exactly does that kick in? It is clear that his apology is less than sincere and is, in fact, hollow as it has not been followed up with any concerted effort to join our celebrations as an elected official who respresents gays and lesbians in Regina and surrounding area."

      Markwart noted that the disappointment was heightened by their understanding that Lukiwski was in the Regina area this weekend. Lukiwski could not be reached for comment.

      In the tape from 1991, which made national news, Lukiwski was recorded saying: "There's As and there's Bs. The As are guys like me. The Bs are homosexual faggots with dirt on their fingernails that transmit disease." The video, released by the Saskatchewan New Democrats, was shot during a party at Saskatchewan Progressive Conservative campaign headquarters when Lukiwski was a provincial Tory.

      In his apology, Lukiwski insisted he is not homophobic and that the comments do not reflect his beliefs then or now. Prime Minister Stephen Harper acknowledged in the House of Commons that Lukiwski's remarks were "completely unacceptable," but said he considered the matter closed. Gay rights groups have noted that just three years ago Lukiwski told the Commons that legalizing same-sex marriage could lead to polygamy and social decline.

      Berlin Remembers Persecuted Gays

      BBC reports:
      Germany has inaugurated a 600,000 euro concrete memorial to honour the thousands of homosexuals persecuted by the Nazis between 1933 and 1945.The four-metre high monument, which has a window showing a film of two men kissing, was unveiled in Berlin. The new memorial - which was inaugurated by Berlin's gay mayor, Klaus Wowereit, and Germany's Culture Minister, Bernd Neumann - is situated close to that for the six million victims of the Holocaust.

      Mr Wowereit said it was typical of post-war Germany that the victims had not been honoured until now. "This is symptomatic for a society... that did not abolish unjust verdicts, but partially continued to implement them; a society which did not acknowledge a group of people as victims, only because they chose another way of life," he said. The Nazis branded homosexuality an aberration threatening their perception of Germans as the master race, and 55,000 gay men were deemed criminals. As many as 15,000 of those were killed in Nazi concentration camps.

      Very few who survived ever received compensation from post-war German governments for the persecution they suffered.

        A Climate of Violence Against Gay People

        (North Carolina, U.S.A) The crimes committed against gay people are too numerous to be counted. And in North Carolina we don't try to count them, because crimes committed on account of a victim's sexual orientation are not classified as "hate crimes" under state law. But make no mistake, gay people are targets. The violence is real and it is systematic. Last semester, I taught the close friend of a young man named Sean Kennedy. My student showed me home videos of his friend Sean dancing in his socks, pretending to skate over the slick linoleum flooring of his mother's kitchen, the way many of us did as kids. Sean is dead. In May 2007, he was assaulted in Greenville, S.C., by a young man who called him "faggot" while punching him so hard that he broke every bone in Sean's face. Sean fell to the pavement; the impact caused his brain to separate from his brain stem. READ MORE

        Gay Basher Kills Himself in Jail

        (Quebec, Canada) Quebec provincial police are investigating the death of Jeffrey Lalonde, 36, who was serving a life sentence in a Quebec prison for his role in a murder that set off a firestorm of gay rights activism, and spurred the creation of the Ottawa Police Service's hate crime unit.

        Lalonde, convicted of the 1989 murder of Chateau Laurier waiter Alain Brosseau, was found dead in his cell at the medium-security Leclerc Institution on Monday after an apparent suicide. Lalonde pleaded guilty to second-degree murder for throwing Brosseau, 33, off the Alexandra Bridge after robbing and assaulting the man as he walked home from a late-night shift at the hotel. Quebec Superior Court Judge Orville Frenette called the attack a "brutal, inhumane act" and handed the then 18-year-old Lalonde a life sentence. Five others, including two youths, were also arrested in connection with a crime spree that began with Brosseau's murder on Aug. 21, 1989.

        The case was cited by several gay rights activist groups that lobbied the federal government to pass anti-hate crime legislation. Ottawa's hate crime unit, Canada's first, was created on Jan. 15, 1993.

        Gay Tennessee Man Terrorized

        Neal Moffitt Anthony from McMinnville, Tennessee, has been terrorized with death threats and harassment over his sexual orientation. Neal Moffitt Anthony has been the target of hate crimes at least eight times this past year. The most recent example happened early in the morning on Friday, May 23, 2008. These photos show the extensive damage, which included spray painting hate messages, breaking windows, cutting the phone line to the house, cutting cables to security cameras, and breaking out security lights.         Stalags: Israel's Dirty Little Secret

        Most of us are familiar with the events surrounding the Holocaust; the photos taken during the liberation in 1945 are etched indelibly into public consciousness. But few of us know what it was like for the survivors after they were freed. Prior to the Eichmann trial of 1961 (when the infamous "architect of the Holocaust," Adolf Eichmann, was tried for crimes against humanity), Israel withdrew into a culture of silence about the second world war. Despite the fact that the children of survivors were brimming with questions, very few of them were offered answers, until K. Tztenik's The House of Dolls was published in 1955.

        K. Tzetnik, nee Yehiel De-Nur, spent two years as a prisoner in Auschwitz and would later become the Holocaust victims' spokesperson at Eichmann's trial (Ka-Tzetnik is Yiddish for "Concentration Camper"). His "historical" book about the camps described how various women prisoners were forced into prostitution by Nazi guards.

        As the first person to break the post-Holocaust silence in Israel and as the spokesperson for its victims, Tzetnik became a sort of national treasure. He remained a lauded figure even when it was discovered that his book was fictional. Banking on the Israeli public's insatiable appetite for details on the Holocaust now that the trial and The House of Dolls had broken the national silence, Stalag fiction was born. MORE

        iTunes.ca Pulls Anti-gay Dancehall Songs

        iTunes Canada has removed several songs with anti-gay lyrics from its online store, in response to a campaign led by Egale and Stop Murder Music. The songs — by Jamaican dancehall artists Buju Banton, Elephant Man and TOK — contain lyrics that advocate the killing of gays. "iTunes is exercising its corporate responsibility by pulling this murder music and raising the bar for other retailers and distributors to do the same," says Akim Larcher (pictured), founder of Stop Murder Music. He calls iTune's decision a victory for the gay community in Canada and in the Caribbean. Egale and Stop Murder Music wrote to iTunes in January, asking for homophobic tracks to be removed from the online store. MORE
